Dear tax experts,

I had the following questions for J-2 visa holders:

1. If a J-2 visa holder with SSN/EAD begins working in Feb. 2009, will the person have to file taxes by April 2009 or by April 2010?

2. Can the above J-2 holder accept employment from an employer and also be self-employed (with a side business) after work hours?

1) 15 April 2010.

2) This is really a legal question which should be posed to an immigration attorney, but probably not. EAD permissions are given to allow the visaholder to seek employment, NOT set up a business to compete with other U.S.-based businesses.

Thanks for the answer! As a corollary to my previous question, can J-2 visa holders accept employment from multiple employers? I read several e-documents stating that J-2 EAD holders do not have an upper limit to their incomes.

I got an excellent suggestion from an immigration attorney. Just quoting it here for other users who are confused about J-2 EAD:

"If there is no restriction on EAD, you can work more than 1 job, or if you are not "employed", you can sell things online, trade stocks, etc. All you need to do is filing income tax accordingly".
