If my co-defendents and I state we did not go into a store to steal shouldn't they drop the conspiracy charge

The prosecuters reviewed a video which clearly does not show me stealing anything however they still want to offer me a felony charge is it because I was with people who were stealing

Hello y:

I suppose that's the reason why. But, if you're NOT guilty, then don't cop out. Hire a lawyer, and DON'T talk to the cops any more.

Hello again, y:

Try to keep ALL your questions regarding your situation on ONE thread... It's MUCH easier that way.

My public defender has had a copy of the video survillance for about 2 weeks he cancels every time we are to meet to review it and he has not reviewed it yet. The prosecuter offered me felony 1. What steps do I take to fire my public defender?

You write a letter to the P.D. and advise him/her that you no longer need his/her services. Because it's a felony 1 charge the Judge may schedule a Hearing to advise you of your rights.

If you do get the P.D.'s services terminated, do you intend to hire private counsel or represent yourself? In my State another P.D. is not necessarily appointed to represent you.

Hello again, y:

If you really want to FIRE your lawyer, Judy told you exactly how to do it... I'd also send a copy to the judge and to the prosecutor...

You should know that I'm a BIG believer in firing those guys IF they're not doing their job... But, simply cancelling a meeting at this point in time, ISN'T grounds to fire him... IF you're going to get another lawyer appointed to your case, you will have to show the judge that you had GROUNDS to fire the first one they appointed.

Often a PD will not meet with you till a few mintues before your next scheduled hearing date, or will talk to you when they do that jail visititations.

But yep, you tell them and they are going to believe you? Ok, not sure who else fell out of their chairs laughting on that one.

No one is ever guility.
If you were with them, and they stole, and you left the store with them and knew they stole, they are going to charge you with the person that stole.

Felony 1 is pretty serious to just go into a building and supposedly "burgle" a business. I'm not following just why this would be a felony charge. Something does not sound right here.

What State and where does it say that? I am not aware of any State that happily assigns one, you "fire" that person, the State (or County) provides another.
