Hi ,
I live in il and divorced in 1994. Two children were born in two years. In my divorce decreed it states I shall get 50 per cent of the pension. Doesn't say for the two years I was married it says 50 per cent. Am I entitled to 50 per cent since it says so ,or 50 per cent of the two years we were married?
At the time it must have been a over-sight on my ex's part and now he is saying by law I can only get 2years. My stand that if it says 50 per-cent with no dates of from when to when it means 50 per cent from when he starts to collect till I die. Is this correct or am I wrong?
Thank-You

It would normally be the 50 percent of the value of those two years that you were married.

Hello doriana:

I would think it means exactly what it says. If it was for two years, I'm sure it would have been clearly stated...

But, it really doesn't matter what it says if he stopped paying. Go back to the attorney who drew up the decree, and ask him. If you're right, you may have to back to divorce court.
