Hello,

While I was doing my OPT from 3/2006 through 10/2006 my employer deducted SS and Medicare taxes. I filed my 2006 tax return not knowing that I could get SS and Medicare back.

What steps do I need to take now that its 2008 and my 06 tax return has been filed and completed? Can I still fill out form 843? Or do I need to amend my 06 return? All of this is so confusing, I'd appreciate any help with the steps I should follow.

1. First you must contact your employer to refund you the FICA taxes as you were exempt individual during your days of F1 and OPT (for 5-years).
2. Evidently, employer can not refund now. But you need employers reply.
3. You must file Form 843 with IRS. You do not amend your tax return.
