I live in Ohio and I'm wondering if BOTH parents have to live in the same city for a judge to approve a shared parenting agreement? The two children involved are 13 and 16 and have lived with their father for five years. The kids want to stay in their current schools.
Their mother is considering going back to court to get shared parenting. She wants the kids to live with her half the week. She lives in another city, another school district, about 20 minutes away. My concern is that it would make it difficult for the kids to get to school on time, or that they would have to get up much earlier to get to school on time. It seems it would be the kids being inconvenienced just to please the one parent who wants shared parenting. Already the mother gets the kids every other weekend, and sees them two nights each week for several hours. What is the law regarding this?

No they don't have to live in the same city, but the Judge will grant the parent where the children are enrolled the school nights and take it from there when the other parent gets visitations.

20 minutes isn't a big deal. What's your real concern ?

Who would be taking the children to school at the school they are registered at when it's her turn to have the kids? Will it be her? If so, then the Judge will probably approve provided she takes the kids to their proper school.
