View Full Version : Can a good tenant with an irrational landlord be kicked out if I'm not on the lease?

I've rented a room in a house for the past 1 1/2 years, I pay rent on time always, I'm quiet and I take great care of the place however, I am not on the lease. I recently haven't been getting along with the guy who is on the lease based on how he's treating the house and "us" as tenants. Now he's threatening to throw my stuff out and says I have no legal recourse. My car is registered to this address, my bills come here, and my stuff is here.

Do I have any legal recourse... can he just throw me out?

Please advise and thanks for your help!

Hello F:

In the absence of a written agreement, you are a month to month tenant. You need to be given 30 days WRITTEN notice.

IF he throws you out, that's an illegal eviction and you can sue him for lots of money for doing that.
