My x-husband and I were granted joint custody of our now 14yr old son in our divorce. Everything seemed great until my then 12 year old daughter revealed that her step-father / my x-husband had molested her. He was convited and sent to prison for just over 6 years. To our disbelief we later found out that he had served 4 yrs. Prior to our meeting for the same thing only it was his son from a previous marriage. So now my questions are can I be awarded sole custody if I petion the court on these grounds? And if so where do I get the forms? He will be released December 2008 and I need to get this done a.s.a.p. second of all someone told me since he is incarcerated his wife now power of attorney and has the same parental rights to act on his behalf as he would if he wasn't incarcerated! Is this true? Please help my son does not want to see his father and has made thi sknown to his step-mom, counslers and myself. Thank you for your help. LAH 11/17/08

This is not something you want to try and do it yourself. Also where are you at, Some states are more user friendly than others.

But on something this serious, you need an attorney.

I live in Kansas I cannot afford a Lawyer right now. Do I even have a chance?
