I fail to keep up my credit card payments settlement agreement and the creditor freeze my bank account with a Writ of Garnishment. I live in Miami, Florida and I barely covering my priorites (food and shelter). I was making my payments until 2 months ago. Ifile a Claim of Exemption under the category of Head of family wages (I provide more than ne-half of the support for a child or other dependent, have net earning of more than $500.00 per week, but have not agreed in writing to have my wages garnished) and request for hearing. My question is have do I prepare myself for the hearing without the presence of an attorney?

First its too late for a hearing. If they froze your bank account they already received a judgement. Though that seems kind of quick if you only stopped paying 2 months ago.

I think you need to nail down what exactly has happened here before we can help.

Sounds like the payment agreement wa some type of summary judgement, because unless they already had a judgement they can not freeze you money. So there is nothing I believe you do at this point but let them get the money
