View Full Version : Landlord broke the lease? Yes or no

Here recently, the whole apartment complex had its electricy and water disconnected due to laste payment. We pay our utilities bills to the landlords directly and the send the money to the suppliers. I was wondering the landlords not paying our bill which caused our electricity and water to be turned off for two days nullified our lease. We only have one month left, but now we are trying to get out now. I am seven months pregnant and thank god that my baby isn't here yet. I really need an answer ASAP.

If, FOR SURE, that was the reason for the interruption in service I would think you'd have a case to terminate your lease early. Do you have PROOF, like in writing?

Carefully read your lease and see exactly what it says about the utilities. I'd also recommend reviewing your state's landlord / tenant laws. There's a "sticky" at the top of the forum with a link for each state.

Finally, there's probably a procedure you'd have to follow in order to legally terminate your lease, if you're entitled to do so.

I guess what I'm leading up to is that you could go through all the right steps and the landlord could still attempt to sue you for what they claim you owe. If you did everything right you'd probable prevail, but it would still be a pain in the butt. Or, if you point out to them "strongly" how and why they are in the wrong and how and why you are entitled to break your lease they may just let you go. I think at this point you just have to weigh out the options and see what makes the most sense.
