Hi everybody
recently I bought 2 iPhone from att and unforyunately left them some where and when I returned they were taken.I called att and now if I cancel the contract I must pay 2x$175 plus $130 monthly charge along with $almost $750 which I alredy paid.att does not offer insurance and claimimg that since I signed the documents I'm responsible.I was not given any document and salesperson made me to sign electroncally without reading the content.
My question is that can att do that to me even though I did not even use the phone and how can I find a lawyer to sue this unfair and unjust treatment by att and I told them that can only happaned in a third world country.I think att needs a class action lawsuit to change their bahaviour.please help me and if you can refer me to a law firm who is espacilized in this field.

Don't cancel the contract. When my Sprint phone was stolen I called them and they turned it off so no-one could use it and run up the bill. Then they sent me another phone. I had the insurance that covers the phone being lost/stolen or damaged. I had to pay a $50 deductible to have it replaced, it's free to fix it though.
Maybe you didn't get the insurance, you should, it's only $3 extra a month or something. But still if you buy another phone it sounds like it would be less expensive than paying all those penalties for cancelling your contract!

Oh, sorry I didn't read your question very well, you said att doesn't offer insurance. That is definitely a rip off. My experiences with att have not been good either. I hope someone can direct you to the right kind of lawyer. I agree with you there should be a class action suit!

Well, you're not going to like what I have to say.

If you wanted to see a contract BEFORE you signed, I'm sure one would have been made available to you. I don't believe any salesperson MADE you sign something... Plus, you really didn't think you could just cancel the contract because you lost the phone, did you?

If ATT doesn't offer insurance, then you shouldn't buy from them, instead of buying from them and then complaining about what they don't sell.

Nope, you don't have a case - not even close.

Ok, you decided you wanted the fancier phones, ATT offers insurance on most of their models, and offers higher deductable on many of the higher priced ones.

As excon said, you did not ask to see the contract and I will be blunt, I have bought dozens of phones and they always give me 10 or 12 papers with it, but if they did not you have the responsibility to ask to see the terms first.

Next you left the phones? Both phones somewhere, where did you leave them,

Your 130 monthly is based on a plan, you should be able to lower the plans to a lesser min,

And every contract that I know of with ATT have a cancell clause, depending on the discount you got buying the phones, you merely pay the listed retail price of the phone ( price of phone without a contract) and a cancell fee.

Or you buy a couple of new phones and go on with the contract.

You are kidding, right? YOU lost the phones and for some reason you think AT&T is responsible for that?

Like Chuck and excon, I see no ripoff here and no case at all. You agreed to purchase the phones. If you didn't get any documentation or read what you signed, that's YOUR fault, not theirs. They are not required to offer insurance. And if you felt that to be a deal breaker then don't buy the phones.

And after spending several hundred dollars on an item you carelessly left it somewhere. Sorry, no law firm would take your case because you don't have one.

Please try to explain how this is a ripoff? Just because they don't offer insurance?

And, if you believe that all sales people lie (untrue btw) then why didn't you read the documents more carefully?

What I see here is someone who was careless with a few hundred dollars worth of equipment but, instead of taking responsibility for that, they are trying to pin the blame on someone else.

But don't take our words for it, go consult an attorney. Many will give you a free consult. I just hope they don't laugh you out of their office. But I guarantee, you won't be there more than 15 minutes.

Okay! Unfortunately I hear this 5 days out the week sir this is not considered a lawsuit by any means at a store you do not sign a electronic contract they give you a paper contract to sign also send a copy of the terms and conditions in the mail or if you have a email address also they are available to read online... pretty much common sense if in case they don't provide you the documents then you can ask for them... now at&t has plenty of options you can purchase a different fone for full price, accept a replacement fone until your next upgrade date which is a Nokia 2600 for 39.99 or add a line of service and get fone or if possible depending on your tenure a early upgrade is done + 75$ fee for the early upgrade but the etf 350 and monthly service fees are valid especially if it is past the 1st 30days of purchase and I'm quite sure you used your iPhone prior to them being "stolen"... :eek:
