Hi,

I live in the state of Georgia. I have been receiving calls from Portfolio Recovery Associates stating an over-due payment for an Open-ended Account. They say that the last payment was made in Dec, 2002 and I owe them now. I was living in the state of Colorado when the account was opened/operated. Since I am living in the state of Georgia, Can you please tell me how to calculate the Statute of Limitations ? Can they sue me now ? When does the SOL expire in my situation ? Please let me know.

SOL in GA on Open-ended accounts is 6 years and 3 years in CO. Both states have a 6 year SOL on written accounts so it would depend on what type of debt this is and whether you can find valid case law to back up the 3 year SOL. How long ago did you move to GA? If SOL had expired in CO before you moved then you should be OK. Did Portfolio contact you via phone or mai? If they have mailed you the initial dunning letter, then respond with a request for debt validation.
