I need some advice from anyone whom might be familiar with this situation. My roommate was involved in a wreck last week and has no insurance on her car. She was driving home from work at around midnight and another lady on the opposite side of the road fell asleep at the wheel and hit my roommate almost head on. My roomates car was totaled and she was taken to the hospital but released with minor injuries. The driver of the SUV broke her neck but was released the next day. The officers advised my roommate that they were unable to find any proof of insurance on the driver of the other vehicle and she was given the drivers phone number in order to call her. When my roommate called she said that she had allowed her insurance to lapse and that technically at the time of the accident she was uninsured. My roommate had her car break down several weeks before and she paid a lot of money in repairs on the car so she allowed her insurance to lapse as well so neither driver was covered at the time of the wreck. The problem now is my friend doesn't no what to do or where to turn, she has only owned this car for about 6 months and still owes the car dealership about $7000.00 on it. She's afraid to tell the car dealership what happened since they require you to carry full coverage insurance. Right now she's having a hard time getting to work because she's without a vehicle and she feels like she's getting the short end of the stick here since none of this was her fault. She contacted a lawyer in Kansas where we live and they were very rude to her so she's at square one and not sure where to go. Anyone out there who has any knowledge of the laws in this area please respond, I want to help her in anyway I can and I want to make sure that this other person doesn't get off just scott free.

Ouch! I watched a bunch of small claims court shows regarding this exact scenario (Hatchett, Mathis, Judy, Brown). All I can say is take her to court and try and get the maximum allowed in your jurisdiction. Good luck!
