My husband and I have fallen seriously behind in our credit card bills and are confused of our rights. I am trying to work on one account at a time to fix these debts but the other accounts I am only sending a $10.00 monthly payment,just for good faith .I have explained that unless I allow us to let our mortgage and other bills go I can not afford anymore than I am sending.Can the take us to court even if I am consistently sending them at least the $10 until we can change that?I am worried that if they try to garnish wagesor file a judgement agaisnst us we will fall behind on our everyday bills.HELP!

Yes, you can be taken to Court unless you have a WRITTEN agreement concerning what you are willing to send and what the creditor is willing to accept. It's an old wives tale that sending "something" keeps a creditor from moving for a Judgment.
