I have just received a notice to appear for pretrial on a credit card (Discover) that was paid through a Chapter 13 starting in 1998. The balance of said Chapter 13 was paid in full in 2002. 1. Is there a statue of limitations in Michigan for credit card debt? 2. I am not sure how to answer the questions on the pretrial statement. Is there help here with that?
Thanks

Hello j:

If the balance was charged off due to bankruptcy, call the attorney up on the telephone and tell him that. He doesn't want to sue if he can't win. Of course, you'll need to send proof.

Excon is right - if it was properly listed on the Bankruptcy Petition (including the correct amount), if no fraud is involved, then it's been paid and you need to tell the Attorney that and provide documentation - by mail, receipt requested, copy to the Court.
