I have past credit card debt of $4200. My last payment was in May 2003. I lost my job in June 2003 and moved to another city. I never left a change of address with the collection agency. I have lived at my new address for 5 years and 4 months. I have started getting calls again in the past month from Vital Recovery Services out of Georgia. Can I still use the statute of limitations for North Carolina even though I moved and never left a forwarding address or phone number in all those years. I don't have a car or own a home and their only option is to garnish my wages. What can I do if I still can't pay this debt?

I'm not sure which state you're currently residing in because you made references to both Georgia and North Carolina. If it's in either one of these states, the SOL has expired; NC has a 3 year and GA has a 4 year. If the SOL has expired, then they have lost their right to legally sue you. If this is the case, I would send them a letter stating that they need to cease any and all attempts to contact you as the SOL has long since expired.

They would use the one where you are now living.
