In April 2007 my uncles friend hit my car while it was parked in his driveway. I didn't realize it was hit until the next day so I didn't call the police and get a report, plus he was my uncles friend. He told me that he would get it fixed, he had me take it to a friend of his who did body work on cars but when he found out how much it was going to cost it was a different story. He then told me that he would pay for parts if I paid for labor or vice versa. I told him no way it was his fault and I wasnn't paying for anything. He then stopped taking my calls and started avoiding me, so I went and got a estimate, about 6 months later, but I never filed a small claim. My question is, is it to late to take him to court ?

First you should if you have full coverage turn it over to your insurance and let them deal with him and his insurance. You should ask to know who his insurance company is.

In the end you sue them,

I would get his insurance info and file a claim with his carrier first.

Whether it is too late to take him to court will depend upon the statute of limitations in your jurisdiction. Most jurisdictions have limitation periods ranging from two to six years for small claims court actions.

If you are dealing with insurance companies (either yours or his) then other rules may also apply.
