Hello:
I've been served with a complaint by Capital One on one of those subprime credit cards. I originally had a $300-$400 credit limit. They are suing me for $1600 including attorney's fees. I am a paralegal so I am familiar with the law and legal terminology, but have never worked in debt collection. I will be appearing in Pro Per. I need to answer the complaint. I believe the complaint is barred by the statute of limitations since the debt is over 4 years old. Does anyone have a sample answer as well as the sample discovery that I need to send out to validate the debt?
