I wouls start by saying "get out". If he doesn't listen, call the police, get a restraining order, do whatever you have to do to protect you... but most imporantly your children.

Calling the cops is a great first step.

I don't know what state you live in but here is a statute that is pretty common.

"In order to evict someone from your home, you must be the person who has legal right to possession of the house or apartment where you live. This generally means that your name must be on the lease agreement, deed, or mortgage, or that you have a landlord-tenant relationship with the owner. The person who you are trying to evict cannot also have a legal right to possession. If you meet these conditions, you must then successfully sue them in court and get a warrant of eviction."

It goes on to say that someone who has lived with you for any serious length of time could be entitled rights. Now, this may be different in your state. Couple things.. Post your state, secondly... Talk to a lawyer.

You should have gave him a written 30 days notice. If that didn't work you could go to housing court and file for an exiction but note this process can sometimes take a long time.

You can call the cops if he is placing you and your children in danger otherwise, depending on the cops, they will tell you to go through the courts. I went through this with a friend but luckily when I called the cops they kicked her out because I voiced I was scared of her and the cops witness her behavior.

It's easy to get people in but hard to get them out.

I totally agree, you need some legal advise from someone who knows the rules and laws where u live.
