I have two boys and there father has been out of the picture since 2000. I am owed 60,000 in child support. No one can find this man. I am now remarried and my boys know his as dad. How do I go about changing there last name with out their bilogical fathers signature?

They can go by whatever name they or you want with out a legal change (which will be a challenge to get) just as long as there is no intend to defraud. So like in school they can be called x instead of y just as long as on legal documents y is used. Have you gone back to court to try to collect support? You might want to hire a PI to try to find him. Is your new husband wanting to adopt?

I have been going to court since 2000. They have issued warrents out for his arrest. I recently had a court date and did not show up for. I also took him to court for custody , but he did not show up. My husband is willing to adopt them! I live in NJ they told me I had to pay x amout of dollars for each adoption. The courts would try to find him to sign the paperwork. If they were not able to find him I would be out all that money.

You need to consult an attorney. There are ways to get a TPR without his signature.

But the only way you will get a legal name change is by adoption.

You would also have to have a lawyer for the adoption process too. Have you contacted an agency like support kids? You have to provide his last known adresso and whatever other information you have on him and they will go to work for you to collect with out charging anything out of pocket and if they are ablt to find him then you would know where he is to ask if he would allow the adoption. Other than that I still say get a PI before anything else with the court so that you aren't out the money.
