How many times can you violate your probation before they sentence you to prison?
Original crimes are retail fraud in first degree ,unlawfully driving away with a vehicle and possession of marijuana and cocaine. I have six misdemeanors, seven felonies, including retail fraud 1st and 2nd degree and assault and battery and forgery. I have been a heroin addict since 2002. I spend more time in the county jail than free, but I continue to violate probation, at least six or seven times. I have never completed probation even before my drug addiction. Usually it's a technical violation but last time it was for criminal activity, possession of less than 25 grams of cocaine and marijuana.

It's not a matter of how many times you violate your probation that matters, it's how upset the judge is with you that matters. He can/will sentence you to serve your sentence in jail anytime he wishes to at your probation violation hearing.

Thanks for a timely answer to my original question, regarding the number of times probation is violated and your answer informing me it's not how many but how much the judge is upset with you. My next questions are; Can or will a probation officer influence the judge? Do p.o. officer's typically lean toward the best interest of the person or the court? I have absconded from probation twice now and I fear my luck is running out. My only chance to stay out of prison will be overcrowding. Any insight you have will be appreciated.

Hello lady:

When you are convicted of a crime, you turn your life over to people who don't necessarily share your view about what's best for you.

In addition to that, PO's are want to be cops. Acting that way is how they get promoted. Consequently, their interest is BUSTING you - not helping you. They, like cops, really get off on that. I'm sure they experience an orgasm when they throw somebody on the ground and step on their head.

You've been on probation for a while. I can't believe you think they're interested in YOU. So, in answer to your question, YES, the judge DOES listen to the PO.

You think overcrowding will keep you out?? Bwa, ha ha ha. If overcrowding mattered, they wouldn't be overcrowded.

Depending on where in Michigan you are you just MAY luck out about the overcrowding thing, but I wouldn't take that to the bank if I were you. The fact you keep absconding is definitely not in your favor.

Right, how many times are they going to watch you disappearing into the distance before they get really, really upset. Probably two.
