My girlfriend and I are considering getting married. She has a little boy that I love to death and his birth father doesn't want to be involved with him. The birth father isn't on his birth certifacte. If we get married what rights will I have and is there any way this guy can come back and make life difficult for us?

Well you have no rights what so ever, except to love the child, but legally you have no status with the child.

And the child's father does not have a right to make it difficult but the child's father does have the right to ask for a DNA test to prove they are the father, and to ask for visitation of his child. This of course is not being difficult only asking for his rights.

If you want to adopt, your wife can hire an attorney to file for an adoptoin though the court if the father will sign over his rights

Are you looking to adopt if the bio dad will allow? Step parents don't have any legal rights. The bio dad dosen't have any rights right now either. However, if he wants rights all he has to do is go to court for a DNA test then the judge will put a visitation and a support order in place as well as have the because changed. If he never goes to court though he may never be involved.
