I have a family member who has recently been to court for child support and at the time the mother was not working. He got stuck with 70% the support for the child since the was not working. Now that she is working can the support be adjusted. In TN support is figured using the income of both parties and if one is not working they are assessed with min. wage. The other question is in regards to visitation. Mother and father live four hours away from each other and mother will not allow father to have the child. Can he go back to court and get visitation and is it possible for them to be required to meet half way because of the distance.

Of course-if there is change of circumstances/she works/

Sure he'll get visitation if he go back to court.No one knows what the judge will decide.There are a lot of factors and reasons there-the child's age , etc.

Yes, he will get visitation but as to the travel that is up to the judge. I have seen it get split half the drive to each parent but I've also seen all to one like said there are many factors that go into that.

Also he shouldn't have been charged with 70% if your meaning of his paycheck because there is a cap on it of 65% and that has to be arrears or 50% if its not as far as child support goes. Sounds like he's getting the shaft.
