I have read that in Texas you can have the parental rights taken away from a father for non support of the children after a year of no child support... I was wondering how you might go about doing this. Also, my ex-husband and my son have the same name and I am afraid that he could be using my son's social security number for credit or maybe even his job to avoid child support. I was wondering if anyone knew how to check this. I think that if he is using it that would be enough for a judge to grant a name change. I don't care if he has his dads last name just not the whole name so he can't use his social security number. Any input would be appreciated.

You can not just have the rights taken away because he is not paying child support. The process that you are talking about is abandonmet. He has to have no contact with your or the child for a period and then you post this ad in the newspaper and if he doesn't to it then you can file for abandonment. I am not sure of the exact process yet. I am looking into it for my daughter and her father. You need to talk to a lawyer and ask them what to do.

As for the social security number "fraud" you need to call the social security office and report it. They can put a block on the social security number so no one can commit any fraud with it. And, if you file for abandonment and get his rights revoked then you can change the last name. I am trying to do that as well. Good luck with everything.

First you can put a watch or a freeze on your child's credit report.
IF he used it, it will be criminal and you can deal with it for fraud.

Actually if he is using it for credit, you call the police since this is ID threft.



Normally no, just not paying support is not enough to take rights away, but you can get child support enforcemnt to go after him

Ok first as anb said you have to go to the local ss office and tell them you suspect fraud. They have many ways of fixing it including changing your son's ssn if necessary. Second, you can not have his rights taken away based off no support. You would also have to prove that there hasn't been any contact of any kind over and entire year as well. Then if you want you can petition the judge to grant a TPR using abandonment as grounds. You can't just file abandonment unless he left the child at a bus stop or something of the sort. The judge isn't likely to terminate his rights. You are better off going to court to have the support order enforced.

Thanks to eveyone who answered. Child support enfrocement is a joke. They have done nothing. I have tried several times, but they just want to catch him or for him to come to them instead. The OAG did suspend his license and he drives the kids around without one, but again, no one seems to care. I just thought changing my sons name first and middle would be easier than dealing with social security as he has autism and in on SDDI. I was just trying to avoid the problem all together, but thanks again to all.
