Hi, how are you?

I got my opt July 2008. And I'm trying to change my visa to H1.

I am sorry to ask you about basic questions, but I do not have any information.

What I know is..

1. find a work place that can sponsor my h1 visa.

- But I don't know until when I should find the sponsor.

2. apply?

- And I also don't know until when I should apply for the h1 visa.

What I heard from friends is that I should find sponsor as soon as possible and I should apply before April, otherwise, I can't get h1 visa.

Is it true?

1. Could you please explain how to get a H1 visa step by step?

2. Is there anyway that I can get h1 visa when the opt is expired?

Thank you so much for your time and help!

For timing, you should start seeking employment asap. Procedures, documents, required by the employer such as getting approval from the Labor Department, etc. takes about 4-6 months. This part must be ready ahead of time as H-1B applications are accepted only once a year in April.

All procedures must be carried out by the employer, or their attorneys, not you.

First search an employer to sponsor your h1b, start project with them, before April you also will be in the h1b filing list, and the sponsoring employer will take care of everything to safeguard your status with their legal experts.
