I am a lesbian and a mother of a three year old son. I have a known donor who before I have my son signed papers I got online about terminating his parental rights and agree to everything that was in the papers. I am wondering, because they weren't done through a lawyer just the two of us signing it with a witnes because that what the website said would do, if I can still talk to a lawyer and still have him sign papers to have his parental rights voluntarily removed?

Did you place his name on the birth certificate ? If not then maybe you won't have to worry about it. As far as papers goes from a website you should have consulted a lawyer for that kind of situation. Right now your in a position where you need to talk to a lawywer and ask how its treated by your state.

Only a court can terminate parental rights. If the donor decided to exercise his rights its likely the document he signed would be ignored by the courts. Since he's not on the because, before he can get rights he would have to prove paternity, get on the b.c and have a court award him custody at some level.

Yes, this is an area of the law that has not reached practice yet, It is very hard to "sign over any rights" and most certainly can not be done prior to the child being born in most states. You need to see an attorney about this.
