I live in Fla. If my exhusband wishes to voluntarily relinquish his parental rights, can he do so. I would like for him to do so and he is willing. I am not seeking any child support nor will I in the future. There would not be a step father or adoption proceeding, I would be the only parent. I have been told by my atty that this may be a problem without an adoption. Any thoughts, and if so, any case law would be appreciated.

If somebody isn't going to adopt in his place then no he can't terminate his rights.
If he doesn't want to see the kid and you don't want to collect child support what is the necessity of signing away his rights?

Your Attorney, in Florida, familiar with the laws and the current Court climate, is correct.

Your attorney is right. There won't be a TPR granted with out a step parent wanting to adopt as well as the two of you willing to do it. If he dosen't want to see the kid and you don't want support then just don't take any support from him and tell him if he does not want to vist just not to. Simple solution because no a judge will not allow his rights to be terminated.
