Hello,

I signed a lease for a college apartment when I thought I was going to go to that school. Just recently I moved 12 hrs from that apartment to live with my fiancé who is in the army, and that complex will not help me get out of the lease. There is no military or emergency clause in the lease. All it is says I have to find a subleaser or pay the full amount of the lease. I wondered if I we were to move up the wedding date if that would get me out of the lease. But I really don't want to have to move up the date if there is some other way to get out. I have been trying to find someone to sub lease the apartment for about 4 months now and I am having no luck.
Any advice?

Moving up your wedding date will not have any bearing on your obligation to the lease. Getting married is not a valid reason to break the lease.

Keep looking for that sub-lessor.

You signed the lease, you entered into a binding agreement.

You can't just change your mind, without paying the price to do so.

I'm afraid you just learned one of life's valuable lessons, unfortunately, the hard way.

The apartment is for one person, I am not allowed to have him move in with me. Even if I were able to we live in totally different state that is no where close. He just got back from Afghanistan and I signed in February before we knew he was coming back. Because his orders are for another state than what we lived in, I thought that by the Soldiers and Sailors Civil Relief Act I would be able to.

He would be able to, you are not.

The SSCRA applies to servicemen and women, not their "future" spouses.

But like I said if we get married and I am his dependent, then would he be able to?

No.

You would have had to be married to him when you signed the lease, not after.

I appreciate your help, I have spoken with the leasing manager and she is going to get me out of it. Thank you though.
