We are behind in our rent because of the slow down of the economy. Several of our customers have filed bankruptcy which hurts a small business like ours. We delivered a 60 day notice to the property management. We did a 60 day because we need ample time to clear out the 30,000 sq. ft warehouse that we have been in for over 11 years. The property management wrote back to me stating that they are sending a 3 day or quit notice and that we need to be out now. In addition, they stated that they will file for eviction and we will have to pay for all fees for this process.

Can the Property Management serve these forms to us after we deliver our 60-day notice?

Yes. If you are behind in your rental payments they can move to evict even if you have given a 60 day notice. Your only option is to bring the rent up to date.
