I am in the process of evicting a tenant. The hearing is in two weeks. He has removed his refrigerator, clothes, beds, food, but the big furniture is still there. I was told as long as the refrigerator and food is gone, he is technically moved and we can take possession. Is this correct?

I would advise you to wait until the hearing.

You made it this far without violating any laws, I think it would be a mistake to not allow this process to run it's course.

If it ends up that the Sheriff has to remove them, they will place all his stuff on the curb once the process has expired.
