Hello,

I was working on my OPT during my year 2005. My H1 started in dec 3rd week of 2005. I filed 1040 along with schedule D for 2005.

Should I amend and change to 1040 -X and also re-send my 1040 NR?

If so, I have my 1040 sent to CA. Should the corrected form be sent to the same address or to the PA address?

Kindly let me know
thank you in advance. This is urgent. If you want more details do send me your email ID and I can send my details or call up if you share your phone number.

My nationality is INDIAN

Since you are an Indian national, it is very likely that the amount of tax will be the same whether you file Form 1040 or 1040NR.

That said, you technically should amend your 2005 return, attaching Form 1040NR to the amendment (Form 1040X). If you file the amendment, send it to the PA address. Also, you should file outForm 8843 and attach it to the amendment.

BTW, there is NO REAL HURRY to do this. You have met the filing deadline, and your amendment only corrects a small administrative matter. As noted above, there should be no change in tax due.
