The home I am renting was on the market and being represented by a national real estate company. The real estate agent advised the home owner to place the home for lease. I signed two rental agreements , one from the real estate co and one with the home owner. As it turns out the home is being foreclosed on and being put back on the market during my lease period. There is a very good chance the agent knew or should have known the owner was losing the home and thus the agent was complicent in creating a lease agreement that could not be honored. Can the real estate agent hide behind the foreclosure forced sale when a live contract is in place that he drafted with full knowledge of the owners situation?
