Hi, I have a child but I'm not with the dad. We were never married and never been to court over custody or anything. He gets her 50% of time and that's it. He believes that since he gets her 50%of time that he doesn't have to help anywhere or with anything else which is fine if he wants to be like that but I'm looking to move out of state with my fiancé to better our lives. I could go into more detail but I'm looking to find out if I can move without going to court first or if anyone or anyone's knows someone that knows more detail please help me out with info. I'm in Mich looking to move to Tenn. Thanks a bunch

Has he been adjudicated the father (DNA)? Is he on the birth certificate?

Yes, he's on the birth cert

Did you go to court after she was born so that the visitation is court ordered? You are more than likely required to have his permission before you move because of his time with her. If there is no court order for the visitation/split custody then you would be able to leave but he could go to court to sue.
