My sister was involved in an abusive relationship. The father of her first child is currently in jail, charged with kicking in a woman's door and threatening her and her child. He has only seen my nephew twice in the two years we've been blessed to have him. My sister just now gave birth to a little girl and is planning on marrying her boyfriend. My nephew only knows her boyfriend as his father and the biological father has already made threats towards my sister and my nephew. How can my sister's new husband adopt my nephew? The biological father would like to stop the procceedings, but his history of being arrested is quite extensive. Could he actually be able to prevent my nephew from having a loving father? Please help!!

Your sister and her husband need to get a lawyer.

With his history of abuse and arrest history, it's possible that they may be able to have the bio father's rights terminated, but if he's fighting it, it's going to be hard. An attorney will know which steps to take and what to do or not to do to make this happen.

Generally there are two ways to get a father's rights terminated. First, to clear the way for an adoption and second if the parent represents a danger to the child. Sounds like both are covered here. I would suggest your sister wait until she is married, some areas require marriage for a specified length of time.

Consult with an attorney who can advise you on when to start the process.
