I live in Florida and have a court order for temporary custody by a family member voluntarily signed by both bio parents. My grandson is now 2.5 years old now and I have had him living with us since his birth. The mother now was hit with child support and wants to give up her rights voluntarily. The father(my step son) is in prison for a few more months but wants full custody eventually. He is only in for VOP. Me and my husband have been the sole supporters or this child from day one. The court order shows abandonment, abuse and neglect on the court order and the father has abandonment showing because of being in prison. The mother raely comes to see him and has never gave a penny towards anything for him. Child support just garnished her wages and has a tax lien on her. She has never showed signs of wanting to be his mother although we have tried reunification procedures. My question is: Can we get her rights terminated without the fathers and without intent to adopt? We are going to give the father the opportunity to become a father to his child but if he fails and goes back on drugs then we will proceed with adoption. Right now the mother is desperate to give up her rights and get out of her responsibilities. It is in the child's best interest to not be with her and I don't for-see some awakening to motherhood happening for her in the near or far away future. Does anyone know Florida law and can help me with what to do? Thanks so much and God Bless all persons whom look out for the best interests of children. They are truly a gift from God!!

Even if she signs her rights away she is still responsible for paying child support by law.
