If I'm livinin in the usa and want to get married but I over stay my time ,and I get marry and went home to my country can the person still fill my document for me still?

Yes BUT your US citizen spouse has to file a waiver for you being overstay which reflects in 3-10 years bar. After the waiver is approved, your spouse can file a petition for immigrant visa for you.

In short... it is doable BUT it must be done by experienced immigration attorney.

Those it usually takes up to the ten years , and by having a lawyer can it make the time shorter less than 3 year?

OK by having a lawyer to handle my immigration case when I return home home form over staying in america if I get marry to a us citizen the bar for the usa is 3 - 10 years by having a lawyer handle my case can that time be reduce from 3- 10 years and be like a year or two?

Basically, the waiver is not about you but it's about your US citizen spouse. For example, if you are breadwinner, and you have small children together, etc. The attorney can use this facts on grounds of hardship US spouse will have to face on his/her own. The government cares about US citizen, not you.

If the reasons are convincing you may be able to get a visa in less than 2 years.
