Hi, I have a question about evicting a person out of my house. We live in United States, Louisiana. He married my husband's mother(his second wife) and came to live in their house. The house belonged to my husband and his mother. His step-father signed an agreement that house will never be his. His wife died about 3 years ago. My husband owns this house now. Does it mean it's mine too just because I am married to him? We all live together in the same house. We never had a good relationship with his step-father. He has guns in the house and I am scared. He refuses to get rid of it and he is 86. He is very emotionally abusive that even his own daughter doesn't want him. I've had enough.I have a 6 year old daughter. Seems like my husband doesn't want to evict him because his step-father pays him something. Can we evict my husband's step-father? He says we can't because he lived there for many years and I came to live here 8 years ago. What does the law say? And do I have a legal right to evict him myself if my husband is reluctant?

Welcome to AMHD. Who owns the home he is living in? How is it titled? Where do you live?

What country is this in, and if in the US what state.

After the death, what happened to the probate, was there a will, whose name is the deed in. Merely living somewhere means nothing, if they don't have a lease, or ownership the owner of the home can file to evict them
