Me and my fianace are going to be visiting his home town where his first is currently living. Him and his ex wife just finalized their divorce and in the agreement it states that my fianace get his son for 6 weeks each year in state. She has know about our visitation now for over 6 months and has agreed. Well now she is saying things to the child saying that we don't want to see him and now that we are leaving tomorrow she has plans and says we can not have him for 5 days. Is that not a breach of contract?? What are his rights. Also, see sent a text message to him one day stating that she was out of state taking care of another child of hers did not inform my fiancé that she had left their son with her new boyfriend for 3 days. We constantly want to talk to his son but she hardly answers the phone and when she does she states that we don't try when we have all of our phone statement. What are our rights plus we want him to be a part of our family and him to see his new brother??

If the ex-wife won't honor the Court Order your boyfriend has to go back to Court and request that she be ordered to do so -

If the mother is a danger to the child (leaving him with the boyfriend may or may not be dangerous) then your boyfriend has to bring that to the Court's attention.

You really have no rights in this - you aren't married to the father and even if you were the two parents would be the primary responsible adults.

Where is the court that adjudicated the divorce? If its in the area where the child lives, then the first thing I would do is go to th court and get an order of enforcement, then go with a police officer to the home to pick up the child.

However, if the court is in your current area, you may be stuck. Since you are leaving tomorrow, you may not have enough time to get an order of enforcement.
