View Full Version : I have guardianship of my grandson can my daughter's rights be taken away?

I have guardianship of my grandson. What would I need to do to have my daughters rights taken away so we can adopt him? She is BiPolar, ADHD, Borderline Personality Disorder to start. She will not stay on her medication, will not stay in one place for more then a few days, will not to therapy the way she should, is in trouble with the law, makes threats and demands to me about seeing him because she still has her rights. I WILL NOT ALLOW her to see him if she is not on her medication and is acting out because he is on 17 months old and should not be exposed to this. She makes threats to do harm to my home, car and myself. She has said she hopes I die a slow painful death and she knows people! I NEED HELP! If she were working her treatment and doing what she needed to do we would work with her. However, she isn't and I have to protect my grandson and will do so even if it means I don't see my daughter. Plus I still have two teenage boys at home as well and will also not expose them to her behavior.

Make a recording of her threats and talk to her doctor or psychologist about declaring her a danger to herself or the baby to use in court as evidence, since you will have to prove she is an unfit mother.

As far as the threats, I would go to the Police - this is less about custody and more about threatening people. Get a restraining order.
And go back to Court and get custody and visitation defined more clearly - I doubt the Court will strip her of her parental rights without her consent but they will order her not to visit - or they will order supervised visitation at a neutral place.
