Hi,

I was a F1 student from Jan - May (and working as research assistant). I have a W2 from this employer. In June I started my full time employment as OPT and have a W2. In Septemeber I received my H1 status. However my employer has been witholding the FICA tax during this OPT period(roughly 6 months)
1)Which form should I use 1040NR or EZ (Am I a resident or non resident)
2)Can I claim the FICA tax return for the 3 month period?
3)Could you suggest some online tax tools

You need to file Form 1040NR or 1040NR-EZ one last time for 2005. In 2006, you will file as a resident alien (Form 1040/1040A/1040EZ).

You can also file Form 843 to try to claim a refund for the Social Security and Medicare taxes withheld while on OPT. Download IRS Pub 519 and read pages 45-47 for details.
