I have a law office threatening to file a lien on any assets we have because of a furniture deferred payment account that my husband had before we got married. I tried to settle with them and they agreed, then changed the terms of the settlement. Question: Can they garnish our check or place a lien on our home (we are buying it but it is not paid for), or seize our checking account. We live in TX, but the account was opened in Kansas about 3-4 years ago. The law office is threatening us with coming after our assets.

Do they already have a judgment?

If not, they won't be able to do anything until they obtain one.

They will have to take you to court before any liens or levy or garnishment could be attempted.

I believe that Texas does not allow garnishment of wages, not sure about property or bank accounts.
