Help, i am two weeks late on a payday loan, was going to pay it back with rebate, but rebate is late. The payday people said they were sending a paper to my employer to garnish my wages. Can they do this without a cout order. I did sign a wage garnishment paper when i got the loan. Help!

If you signed a confession of judgment, or wage garnishment form, then you are getting exactly what you agreed to.

Why would they need a court order, if they have your signature on such a document?

Unless there is some statute that prohibits such an agreement in your jurisdiction, then they are free to garnish you, with your permission, which has already been granted.

No, they do not have to go to court, since you signed an agreement to allow the money to be held from your pay.
Of course once you pay them back from the paycheck, then when you get the tax money it will be yours to get caught back up on.

Also never, ever, never use a payday loan place, it is the closest thing to a loan shark that is allowed by law.

If you signed a wage garnishment, then they have you were they want you. As Fr_Chuck has stated these places are nothing more than loan sharks. Many states are now wising up to these places and putting them out of business.
