View Full Version : Walk away from home in foreclosure

I have been trying to save our home that has been in foreclosure for two years. We have had 4 re-fainance apporvals all have fallen through due to cxurrent lender refusing to submit payoff on time. We have already moved out and just want to give up th efight and give them the property. Credit is already ruined due to the time we spent fighting them in court, they now have moved to go to a trial-any advice

Document with the real estate agents you were working with that they refused to provide the pay off. This with some lenders is not uncommon at all. I had one lender last year that would take up to 6 weeks to get a payoff and by the time it was sent, it was already 2 or 3 weeks old.
This may help from allowing them to add a bunch of fees. But if you just walk away, and don't show up it will still go into foreclosure.

It is already in foreclosure, we have been in this for two years fighting the current lender-do you have any knowledge of what they can attach if the house sells for less than we owe.

They would get a judgemenent after that, what they can do will depend upon what state you are living in.
