My brothers ex-wife is moving to the west coast from the east coast & plans to take their 2 daughters ages 11 & 13 with her. The reason for the move is she is getting re-married. They have joint custody but primary living custody is with their mom. They currently live 2miles from their dad & he sees them every Wednesday & every other weekend. What rights does the dad have & how much will the judge take in consideration the girls wishes? Does this also change his support payments?

Don't know what the divorce papers say but Court permission should be obtained and your brother can file for a new Order - at that age the Judge will listen to the girls but they will not have the final say. The "ex" will most probably have to pay to fly them back and forth for visitation.

And, no, it doesn't change his support payments - they still need to eat, no matter where they live.

He can request that she don't move with the girls, depends as noted on the documents from original custody. But he needs a great attorney.
