My husband's previous wife said he has to pay child support for his son until he is 19, because she decided not to enroll him in school until he was 6 years old and he will not graduate high school until he is 19. They got divorced in the state of GA and she now resides in Virginia. She has sole custody of their son. Is this true?

It all depends on the divorce decree. Generally speaking the limit is 18 or until the child no longer attends school. Most jurisdictions 18 is considered an adult. But it could be 21 or 22 if college is included in the original decree.

As donn notes this should be spelled out in the divorce decree. The divorce decree probably states either 18 or when he finishes school. Depending on how its worded this could include college.

This is normal, most ( but please read his actual court order) state that support will be paid to 18 unless they are in school, and normally go up to 21 or 23 if they stay in school ( normally refers to college)

So my guess without reading his order is yes that he will have to.

Twinks,

I understand your frustations so well. I also had very intrusive in-laws. The dynamics of married couples becomes much more difficult with them. However, it can be very enriching if you live with them your live very much. Try to stablish rules and ask them not to intrude unless asked for.

Regarding you wife, sorry man. I think you messed up... Don't say you are going to leave unless you intend to. You are sending mixed signals to her and because you mentioned you want things to work out. I would appologize, applogize 1MM time if necessary. Pick you battle man. Go clean up the hour, this is good work out anyway. Show to her you love her with actions. You'll see things will come back...
