View Full Version : How do I go about getting the Parental Rights of my ex revoked?

I am trying to get my ex's rights to my son revoked. He can't stay out of jail, can't stop using drugs. I already have sole legal and physical custody, he was only awarded 1 supervised visitation a month and he has opted not to show for any but one of them in 3 years. He doesn't pay child support and doesn't uphold his end of the divorce judgment. I also have a transcript of when I took him to court and pkead guilty to Battery, simple battery, obstruction, and child endangerment. He threatened my son's life, all of which is documented by the courts hense the supervised visitation. But now I really want to not have to ever think about him again, he clearly wants nothing to do with us but refuses to release his rights. What do I do?

The only way I am aware of is that he has to be willing to give them up freely. As my x hubby did. It was sweet and sour, the day will come you will understand. However, if you feel that threatened and the courts have placed him on supervised visitation then your attorney can request that on your behalf. Good luck

You can't force him to give up his rights. You can force him to pay child support though. Go to the support agency and start the paperwork rolling. He cannot refuse to pay or he faces possible jail time.

In some states if he is in prison and a convicted felon, at times you can get his rights taken away. But you will have to look into your states law.
But to do it, you will need to hire an attorney, it is not always easy and will not be normally cheap
