I had a TPO hearing on 4/10/08 to determine if the judge would continue the order. My attorney was trying to get with my STBX attorney before the hearing to come up with a divorce settlement and put a mutual TPO in the divorce decree. Needless to say, it never got this far because my STBX was calling me names in the hallway and my brother heard him and came out in the hallway and confronted him. My brother ended up punching him in the jaw. They arrested my brother after the hearing was over and nothing was resolved as far as the divorce goes. My eyewitness (nephew) even seemed like he was testifying for my STBX unwittingly. I don't feel like my attorney fault for me enough because this monster was given overnite visits with our 8 yo daughter from Friday evening until Monday a.m. when he drops her off at school. To pour salt in the wound, he picked her up Friday from school and I didn't hear from her until Sunday 12pm when he, his sister and mother decided to let her call me from her cell phone. He was ordered to pay child support which I sure he won't pay. Is there anything I can do to turn this disaster around. I really just want this thing over with and I am pretty sure that after my brother popped him, he is not going to cooperate with anything from this point on and it seemed like the judge totally discounted everything I had to say and my police reports. He only gave me a 3 month extension on my TPO. What is wrong with these judges? Does he need to kill me first before I am taken seriously?

You heard your husband's comments; who else heard them? You may consider having everyone that heard him make an affidavit, and make the affidavit(s) a part of the record at the next hearing to prove his continuing abusive tendencies.
