My child's father has never seen her. He has paid child support off and on for three years. He will go five or six months at a time without paying. He acts like it is such a burden to have to pay the little amount of child support that he pays. I have told him that if it is an issue for him than we can fix it and he can sign his rights over. He has always refused but he doesn't want to do anything for her. My child has talked to him on the phone before but she doesn't know who she is talking to. She is just saying hey to who I am telling to. He has made no attempt for contact in the past year. He has made no attempt to see her in the past four years. I would like his rights taken away. I know that he will not willingly do it. What ways can I get his rights taken away without his consent?

Believe me, I wish I knew. You do need to go to court to get him to pay his child support. My guess is they are not taken out of his pay check. This can be done! File your court papers, and every time he complains about the money, just say, 'all you have to do is file over your rights!'

You need to go back to court and tell them he will not pay.
Support and visitations are two separate issues and what would taking away his rights do except get him off the hook! I would keep going back to court until he paid up!

You can not force him to visit, but you can force him to pay.

Also even if he gave up his rights, that does not stop the legal obligation to pay child support in most cases unless there is an adoption.
