View Full Version : Does Eviction paperwork have to be exact?

Myself and my sister are in the process of being evicted from an apartment for non-payment of rent ( we can't afford the rent increase). The paperwork received so far has my sister's name wrong (With different last name) and I am not even listed on the 3 day notice and the rest of the paperwork. I have lived here for several years and the Manager knows that I have.

Is this enough to negate the eviction process and make the landlord start the process over again? I am trying buy some time before I have to leave

Yes, and no. Sure, they should have the right name. But, even though they evicted "john doe", when the sheriff comes to put him out, they'll put you out too.

I was going to ask who is on the lease but this is a far better answer!

You may be just a guest or other household member if the original rental or lease was in just your sisters name.

And no I doubt it will be enough to stop the eviction. But you can try of course if you get a liberal judge that is very pro tenant, they may rule in your favor
