Hello All,
I would like to start this off by saying to please not lecture me, I know what I did is wrong and a special kind of stupid. I will be seeking help as this was a true eye opener.
This Saturday I was arrested for my second DUI, the first was quite a while ago. I don't know exactly how long ago it was but I know it was within 10 years but definitely over 3. I don't know whether I'm still on probation or not, it was court probation so I didn't have to report to anyone. Due to this I'm asking for 2 answers one for if I were still on probation and the other if I were no longer in probation.
I wasn't speeding or anything at the time and when I asked the police officer why he pulled me over he said he would tell me after I gave him my license and registration, which he never did, I don't know whether this will affect the case but I'm giving all details I can. My first DUI was in Los Angeles county and this last one was in Riverside county, again don't know whether that matters or not. I have not paid off the fines for my original DUI so it's still an open case, my court date for my second DUI is in May of this year and I hope to have all fines paid by the time I go into court so the previous case can be closed. Since I never paid the previous fines I couldn't get my license back so aside from the DUI charge they also hit me w/ driving w/ a suspended license. I've looked around on the net and it seems that for a second offense there's sometimes 96 hours of jail time, is there a way to avoid this? A friend of mine went through this whom I don't talk to anymore but I remember him doing some time on the weekends. If I do have to do time how can I get this as I don't want to lose my job! I also declined a breathalyzer and opted for a blood test hoping that would give me some additional time so my BAC would go down some, is this going to work against me in court?
Any help would be greatly appreciated. I'm sorry that this happened and wish I could apologize to my community, as I said this is an eye opener and will be seeking help. All my problems in life can more than likely be traced to alcohol so I want to quit altogether but frankly don't know if I have the strength which is why I will be seeking help. Will it help if I took something to show the judge I got help prior to even coming into court.
