I received a summons for a Providian credit card debt that has been purchased by Cach LLC.. I have read the forums suggesting that I request validation of the debt in the form of my original signed contract with Providian.
Included as an exhibit in the summons was one of my providian statements stating I was past due. Also included was an affidavit form signed by an agent of Providian saying that my account was unpaid and that Providian had sold and conveyed all collection rights to Cach LLC. They also included a copy of the credit card agreement, but this was not a copy with my signature or on it.
My question is even though they did not include a copy of my signed contract, don't they have enough validation for court / a judge?
